La Mesa Attorney Scott McMillan - McMillan Law Firm

First the obvious: this blog is not associated with Scott McMillan, The McMillan Law Firm, La Mesa, California, www.McMillanLaw.us, located next to the railroad tracks (literally) at 4670 Nebo Drive La Mesa, CA 91941. There are other attorneys who share the name “Scott McMillan” and do not want to confuse consumers with which Scott McMillan this blog and consumer alert pertains to.

It appears that Scott McMillan has a 100% Loss Rate in the Court of Appeal, Fourth District, Division One [San Diego]. On one hand it looks like Scott McMillan proclaims he has appellate and business litigation expertise as stated on his website, but fails to provide any record of succeeding in a single appeal or writ petition.

I find particularly disturbing that La Mesa Attorney Scott McMillan will allege “We are a results oriented law firm" and "The McMillan Law Firm, APC is San Diego's leading business litigation, employment law, and real estate litigation law firm..."- www.McMillanLaw.us . I see nothing indicating any recent great success by Scott McMillan in the trial court to be deemed a "leading business litigation" firm, or any success in the appellate court. This could be due to the fact Scott McMillan graduated from an unaccredited law school [Western Sierra School of Law], that at the time was tucked away behind a car dealership in a strip mall [relocated to a different strip mall], or simply bad lawyering. Further, neither of the major Southern California legal publications, San Diego Dailey Transcript or Los Angeles Dailey Journal, appear to recognize Scott McMillan, or The McMillan Law Firm, as being a “leading” law firm in any field.

Further, www.McMillanLaw.us, has a handful of ‘victories’ cited, but the most recent appears to be in 2007. Nonetheless, the half dozen ‘victories’ Scott McMillan boasts is what many (true) litigation powerhouse firms get in a few months not years. For example, one of the leading appellate firms, Horvitz & Levy, takes up multiple pages of its website to cite its recent wins, http://horvitzlevy.com/news/wins.cfm Similarly, leading appellate firm, Greines Martin Stein & Richland, also needs plenty of room to list its recent wins, http://www.gmsr.com/news_wins.cfm However, Scott McMillan does not appear to have any wins in the Court of Appeal [San Diego], but in the same breath proclaims his ability to handle appeals. Considering Scott McMillan has lost about 40+ cases in the Court of Appeal [San Diego], I think it is tragic to waste precious judicial resources and put the opposing side through the cost of an appeal. Of course, I can only presume The McMillan Law Firm also charged its clients for going to the Court of Appeal.

Of course not every appeal is won, however the fact Scott McMillan holds himself out to be an appellate attorney, being "results oriented" and a "leading business litigation" firm then that's where I think a used car salesmen looks more reputable compared to Scott McMillan.I think it’s a dangerous combination and may constitute misrepresentation of credentials to clients to make such statements. In short, people seek out attorneys who succeed, but Scott McMillan appears to fail his clients with every appeal or writ filed.

Nonetheless, in an effort to inform and protect consumers, I believe parsing out fact from fiction is important prior to embracing the representations of any professional. Another example of potential misrepresentations may be present where Scott McMillan operates the McMillan Academy of Law, www.maol.info, however doesn't have a single student to my knowledge or single graduate who has passed the State Bar exam - thus how can there be a school without a student?

I encourage you to review the Court of Appeal, Fourth District, Division One's website and enter “Scott McMillan” name [attorney section] to review what the court decided in each of Scott McMillan's appeals and writ petitions. From what I’ve found, Scott McMillan has lost each of the below cases:
